| Updated: Witness gives details of events leading up to homicide Tue, 12 Aug 2008 19:33:00 EST QUINCY — Jurors in Quintarious Shorter's first-degree murder trial heard from prosecutors Tuesday about rival groups, a fist fight and a threat that Shorter allegedly shouted the night before Travis Green was shot dead seven years ago. But there are no eye witnesses to the April 25, 2001 shooting. And no weapon was ever found, defense attorney Clyde Taylor told the six-person jury in his opening statement Tuesday. "None of it," Taylor said of the prosecution's evidence, "points to Quintarious Shorter as having a gun on the morning of April 25, of shooting a gun on the morning of April 25." Green was shot at about 10 a.m. He was hit by seven bullets from two guns, including the shot to the back of his neck that went through his head and killed him, Medical Examiner Charles Manning said in a video deposition. Shorter's trial started Monday with jury selection and continued Tuesday with the first testimony in the case. Assistant State Attorney Mark Johnson argued that two men, Shorter and Gabriel James, shot and killed Green as part of a "turf war" in Sawdust, a rural community of about 500 people seven miles outside Quincy. Shorter and James are among seven Sawdust residents indicted earlier this year on drug and racketeering charges. Prosecutors have taken the death penalty off the table in Shorter's murder trial. James is expected to be tried for murder separately. The prosecution's first witness, Jamaya McSwain, was Green's cousin and lived next to Green, 21, at the time of Green's death. He said that the night before the shooting he accompanied Green and two other cousins, Cornelius and Carlos Cobbs, to the housing project where Shorter and the others lived. He said they had known each other from their school days and had had an altercation earlier that day. When the two groups met up, McSwain said, Cornelius Cobbs punched Shorter and a fight broke out. After the fight ended, McSwain said, he heard Shorter say "take me to get my gun, I'm going to kill (them)." "He was real mad," McSwain testified. Later that night, McSwain said, Shorter and three others drove up to Green's house. All four men were armed with handguns, he said. McSwain said he saw them approach, armed himself with a 12-gauge shotgun and hid in a tree. He said he saw the four men approach a nearby mobile home where McSwain's grandmother lived, and he got ready to shoot them because he feared for her safety. But Shorter's brother, Terrance Shorter, stopped just short of knocking at the door. Instead, the four men got back in their car and left. At about 9:30 the next morning, Cornethia Roberts was driving her brother Willie Washington to work at Quincy Farms when they saw Shorter and James walking in the area where Green was later found dead. At about 10 a.m., Roberts testified, she was back home when she heard several gunshots. She went to her back window, saw Green lying motionless in her backyard, and called 911. |

O'Duor announced the termination of Charlie Toomer to FAMU's board of trustees Monday.
